Vietnamese labor law allows foreign nationals to work in Vietnam only if they meet specific requirements and obtain a valid work permit (or other legal exemptions). Employers must prove that the position cannot be filled by a Vietnamese worker unless the job is in short supply or requires international expertise.

- Work Permit

Most foreign employees must obtain a Work Permit issued by the Department of Labor, Invalids and Social Affairs (DoLISA). The process includes:

  • Valid job offer from a Vietnamese-registered company

  • Approval of job position as "necessary" for foreign hire

  • Health check and criminal background clearance

  • Certified qualifications and work experience

Validity: Up to 2 years (can be renewed once)

Some foreign workers may be exempt from a work permit, including:

  • Short-term assignments under 30 days

  • Intra-company transfers

  • Foreigners married to Vietnamese citizens

  • Students on internship programs

- Temporary Residence Card (TRC)

Once the Work Permit is issued, the employee can apply for a Temporary Residence Card, allowing legal stay in Vietnam during the employment period (typically 1–2 years).
