04 Notes In Case Of Consensual Divorce

Divorce

Before pursuing consensual divorce, confirm that both spouses agree on the essential issues and understand the court's role. Document readiness, participation requirements and any outstanding arrangements for children or property can matter more than an advertised completion period. The discussion separates legal requirements from practical preparation and identifies the issues to clarify before taking the next step. It explains why the documents, degree of agreement and specific relief requested should guide the approach rather than a general promise about timing or outcome.

Confirm genuine agreement

Consensual divorce requires both spouses to be genuinely willing to end the marriage. Article 55 of the 2014 Law on Marriage and Family also requires the court to review the relevant arrangements for property and children on the basis of protecting the legitimate interests of the wife and children.

Agreement should be clear about direct care, support and financial matters. Where an issue is not being requested for determination, the scope should be stated accurately rather than suggesting a dispute has been finally resolved when it has not.

04 Notes In Case Of Consensual Divorce — document preparation and legal review

The court recognises the divorce

Spouses do not become divorced simply by signing a joint request or living apart. The competent court reviews the application and the parties' wishes, follows the relevant procedure and issues its decision if the requirements are satisfied.

Check current court competence and territorial jurisdiction. The court structure changed under the 2025 civil-procedure amendments, so the filing location should be confirmed for the present case.

Plan timing from the actual file

04 Notes In Case Of Consensual Divorce — practical consultation and next steps

A complete and consistent application can reduce avoidable requests for correction. The time still depends on document readiness, participation, court review and any foreign elements. There is no general thirty-day shortcut applicable to every consensual divorce.

If either spouse changes position or substantial issues remain disputed, the procedural route may need to be reassessed. An advertised completion period cannot replace that assessment.

Understand costs and practical obligations

Separate court fees and other procedural costs from any legal-service fee. The amount and responsibility for payment depend on the requests, applicable exemptions and work required. A written engagement should explain the legal assistance offered and the costs it covers.

Keep the court's payment notices and receipts and clarify any additional expense for translations, foreign documents or other necessary work before assuming the initial fee covers the entire procedure.
