Divorce annotation refers to the legal procedure of recording a divorce or marriage annulment resolved by competent foreign authorities into the Civil Status Register of Vietnam. According to Article 37 of Decree 123/2015, when citizens of Vietnam finalize a divorce abroad and subsequently return to reside in the country, or when individuals wish to register a new marriage at a competent authority in Vietnam, updating the civil status register is mandatory. This process ensures the foreign divorce decree is recognized under the legal framework of Vietnam. If a person has gone through multiple divorces abroad, the law only requires registering the most recent divorce.

To successfully record the divorce, applicants must prepare a complete dossier as outlined in Article 39 of Decree 123/2015:
Note: Documents issued by foreign authorities must undergo consular legalization and be translated into Vietnamese, unless international treaties that Vietnam is a signatory to regulate otherwise.
According to Article 48 of the Law on Civil Status 2014 and Article 38 of Decree 123/2015, the district-level People Committee holds the authority to process divorce annotations. However, since the abolition of district-level governments in Vietnam, Commune-level People Committees are the competent authorities in handling this procedure.
