Understanding Divorce Annotation Under Vietnamese Law

Divorce 11/03/2026

Divorce annotation stands as a crucial step for citizens of Vietnam who have completed a divorce abroad. To ensure the foreign divorce is fully recognized and enforced within the country, individuals must officially record the event through competent authorities. Completing this procedure updates the civil status database and prevents unexpected legal roadblocks.

Divorce annotation is an essential legal step for citizens of Vietnam who have completed a divorce abroad. To ensure the foreign divorce is reflected and enforced in Vietnam, individuals must officially record the event. This article from Apolo Lawyers explains the concept, required conditions, necessary paperwork, and official procedures based on the Law on Civil Status 2014 and Decree 123/2015/ND-CP (Decree 123/2015). For professional consultation and dedicated support, please contact our Hotline at +84 979.489.879Apolo Lawyers remains committed to assisting our clients through every step of their legal issues.

1. What Is Divorce Annotation?

Divorce annotation refers to the legal procedure of recording a divorce or marriage annulment resolved by competent foreign authorities into the Civil Status Register of Vietnam. According to Article 37 of Decree 123/2015, when citizens of Vietnam finalize a divorce abroad and subsequently return to reside in the country, or when individuals wish to register a new marriage at a competent authority in Vietnam, updating the civil status register is mandatory. This process ensures the foreign divorce decree is recognized under the legal framework of Vietnam. If a person has gone through multiple divorces abroad, the law only requires registering the most recent divorce.

2. Required Documents for Divorce Annotation

To successfully record the divorce, applicants must prepare a complete dossier as outlined in Article 39 of Decree 123/2015:

  • A completed application form for divorce annotation as prescribed by the Ministry of Justice.
  • A copy of the legally effective foreign divorce judgment, decision, or agreement.
  • Identification documents (passport or identity card) of the applicant for verification.
  • Proof of residence to determine the correct administrative jurisdiction.

Note: Documents issued by foreign authorities must undergo consular legalization and be translated into Vietnamese, unless international treaties that Vietnam is a signatory to regulate otherwise.

3. Competent Authority and Procedure

According to Article 48 of the Law on Civil Status 2014 and Article 38 of Decree 123/2015, the district-level People Committee holds the authority to process divorce annotations. However, since the abolition of district-level governments in Vietnam, Commune-level People Committees are the competent authorities in handling this procedure.

Procedure:

  • Submission: Submit the prepared dossier to the Civil Status office belonging to the competent People Committee. The submission can be in person, via postal service, or through the national public service portal online.
  • Review: Civil status officers verify the application and cross-check the foreign documents.
  • Result: Within 5 to 10 working days, depending on whether further verification is needed, the applicant receives an official extract of civil status confirming the divorce annotation.
