1. What is a foreigner under current Vietnamese law?

A foreigner is a person who is not a citizen or national of the country in which they are currently residing or visiting. The term foreigner is used to refer to individuals who are from a different country or have a different nationality than the one they are currently in.

Pursuant to the provisions of Clause 1, Article 3 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014 as follows: Foreigner means a person carrying a document identifying foreign nationality and a stateless person entering, exiting, transiting or residing in Vietnam.

2. Do foreigners who already have a passport if they want to travel in Vietnam, do they need a visa?

According to regulations, a visa is a document issued by a competent Vietnamese agency that allows foreigners to enter Vietnam. Pursuant to Clause 17, Article 8 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014 states that visas with the symbol DL will be issued to foreigners entering Vietnam for tourism.

Pursuant to Clause 2, Article 9 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014, the visa with the symbol DL is valid for no more than 03 months. However, the visa can be valid once or many times, except for the e-visa, so if you want to stay for more than 3 months, you can extend it.

Besides, about the visa conditions, according to Article 10 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014, as amended and supplemented by Point b, Clause 5, Article 1. The 2019 Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam is amended as follows:

  • Have a passport or valid international travel documents.
  • There are agencies, organizations and individuals in Vietnam to invite or guarantee, except for the cases specified in Article 16a, Article 16b and Clause 3, Article 17 of this Law.
  • Not falling into the cases where entry is not allowed specified in Article 21 of this Law.
  • In the following cases, when applying for a visa, documents proving the purpose of entry are required:
  • Foreigners who invest in must have papers proving their investment in Vietnam according to the provisions of the Law on Investment;
    • Foreigners who practice law in Vietnam must have a license to practice law in accordance with the Law on Lawyers;
    • Foreigners who come to work must have a work permit in accordance with the provisions of the Labor Code;
    • Foreigners entering to study must have a written receipt from the Vietnamese school or educational institution.
  • Electronic visas are issued to foreigners who have passports and are not subject to the provisions of Clauses 1, 2, 3 and 4, Article 8 of this Law.

Accordingly, foreigners who do not have a visa but apply for a visa must comply with the above provisions.

3. How do foreigners get visas from competent agencies of Vietnam abroad?

Pursuant to the provisions of Article 17 of the Law on entry, exit, transit and residence of foreigners in Vietnam 2014, Issuance of visas at overseas Vietnamese visa-issuing agencies:

  • Within 01 working day from the date of receipt of instructions from a competent authority of the Ministry of Foreign Affairs and the passport and visa application form with a photo attached, for the case specified in Clause 2 of this Article. 15 of this Law, the visa-issuing authority of Vietnam abroad shall issue visas.
  • In the case not specified in Clause 1 of this Article, after receiving the notice of the inviting or guarantoring agency, organization or individual, the foreigner who is required to have a visa shall submit his/her passport and declaration Visa application and photo at the competent visa-issuing agency of Vietnam abroad. Children under 14 years old who share a passport with a parent or guardian are not required to apply for a visa in case they share a passport with a parent or guardian. Within 03 working days from the date of receiving the notice from the immigration management agency or the competent authority of the Ministry of Foreign Affairs, the overseas visa-issuing authority of Vietnam shall carry out the following procedures: visa issuance.
  • The head of the visa-issuing authority of Vietnam abroad shall grant a visa valid for no more than 30 days to foreigners wishing to enter Vietnam to survey the market, travel or visit people. medical treatment in the following cases:
    • Persons who have a working relationship with the Vietnamese visa-issuing authority abroad and their spouses, children or the person who has a written request from the competent agency of the Ministry of Foreign Affairs of the host country;
    • Persons with guarantee notes of diplomatic missions, consular offices of countries located in host countries.
  • After granting a visa for the case specified in Clause 3 of this Article, the head of the overseas visa-issuing authority of Vietnam must notify the immigration authority and take responsibility for it. responsible for the issuance of visas.

Accordingly, foreigners are granted visas by competent agencies of Vietnam abroad according to the above provisions.
