Before filing for divorce, separate the decision to end the marriage from the consequences that also need attention. Children, support, ownership and debts may require their own evidence, even where both spouses agree that the marriage should end.
Divorce requires a legally effective court outcome
Living apart or signing a private agreement does not itself terminate the marriage. A divorce takes legal effect through the relevant judgment or decision. Before filing, identify the appropriate route and the issues concerning children, support, property and debts that require attention.

Assess who may request the divorce
Article 51 addresses requests by spouses and certain requests by relatives under specified conditions. Restrictions on a husband’s right to request divorce must be distinguished from the wife’s own right to seek it. Avoid treating a filing restriction as a statement that no divorce is legally possible in every related situation.
Prepare the request and evidence

Bring the marriage record, identity and current residence information and the other spouse’s known location. Add records supporting the grounds or agreement and each parenting or financial request. The court’s assessment of an agreement is not automatic merely because the spouses sign it. Check current competence and any foreign-document questions before submission.
Follow the case and review the decision
Respond to notices, requests for documents and fee-related directions. Confirm participation and the next required step. When a decision is issued, review its effect and any available challenge against the actual procedure and notification details. A lawyer can explain the options without promising a result or treating every decision as subject to the same appeal route.
