Types of divorce in Vietnam

Vietnamese divorce procedures differ according to whether the spouses genuinely agree and whether the legal grounds must be established in a contested case. Foreign elements do not create a shortcut; they add questions about jurisdiction, documents and participation.

Consensual divorce

A consensual request is based on both spouses’ genuine voluntary decision and assessment of their arrangements concerning children and property under the applicable conditions. Record the agreement clearly and distinguish agreed terms from matters still in dispute. A private agreement does not itself replace the legally effective court decision needed to end the marriage.

Divorce at the request of one spouse

A unilateral request requires review of the legal grounds and the supporting facts. The other spouse’s opposition does not alone determine the outcome, and the applicant’s wish to divorce does not remove the need to establish the relevant requirements. Parenting and financial questions should be presented with their own evidence and proposals.

Foreign elements can affect either route

Foreign nationality, overseas residence, foreign-issued documents or property abroad can raise additional issues. Check current court competence, international and territorial jurisdiction, notice and document formalities. A foreign element is not a separate shortcut and should not be treated as a reason to rely automatically on an old provincial-court instruction.

Choose the file that reflects the real circumstances

Prepare marriage, identity and residence records and documents relevant to the requests. Explain what is agreed, what is disputed and whether any proceedings or decisions already exist elsewhere. Participation and reconciliation requirements depend on the applicable procedure.
