1/ What is consensual divorce?

A consensual divorce is a case in which a husband and wife jointly request a divorce and have reached an agreement on all issues of common property and children. Thus, if the husband and wife initially agree to divorce, but during the Court settlement, one of the parties wants to change the agreements and does not agree on the above issues, the Court cannot recognize the consensual divorce.

In case of consensual divorce, the husband and wife will make a petition to recognize the consensual nature of the divorce so that the Court can handle all issues including:

2/ Change The Agreement In Case Of Consensual Divorce

In this case, the Court will accept and settle the request of the husband and wife, this is a civil matter settlement procedure. On the contrary, if in the process of requesting the Court to recognize the consensual divorce, one of the spouses want to change the agreement such as not wanting a divorce or being unable to agree on the settlement of common property or child issues, supporting for children. In this case, the Court will suspend the settlement of the request for recognition of consensual divorce but proceed to accept the divorce case for settlement, so one of the spouses will be the Plaintiff, the other will be the Plaintiff. The defendant and your case will be resolved as a unilateral divorce case.
